NEW YORK ENACTS E RECORDING LAW

New York State Governor Andrew Cuomo this past week signed a bill allowing county clerks throughout the state to record land records electronically in their offices.  New York was the last state in the country to permit such filings.

“County Clerks across the state have lobbied the State Legislature to allow e-recording for nearly a decade and now it will become a reality in New York,” commented County Clerk Judy Pascale.

Several states throughout the country permit banks and title companies to record documents electronically, making the process significantly more uniform and speeding up the time it takes to have the documents available in the county clerk’s offices.  The new law in New York permits county clerks to record documents electronically, but does not mandate it.

“Eventually we will replace an antiquated practice of stamping and filing with a system that makes real estate transactions seamless and instantaneous.  This will undoubtedly bring about greater efficiencies and reduced costs for the taxpayer,” stated Pascale.

Passed overwhelmingly in both chambers of the legislature, the new law amends both State Technology Law and Real Property Law.  The Bill was signed by Governor Cuomo on September 23rd.
