Review of Suffolk County Aquaculture Lease Program

The Department of Economic Development and Planning (Department) is designated as the County entity responsible for implementing the Suffolk County Shellfish Aquaculture Lease Program in Peconic Bay and Gardiners Bay (Lease Program). As stipulated in Article §13-0302 “Lands underwater of Gardiner's and Peconic bays” of the New York State Environmental Conservation Law and codified in Chapter 475, Article II of the Suffolk County Code; Suffolk County is required to conduct an administrative review and revisions to shellfish cultivation zone map(s) every five years. The Lease Program was adopted by the Suffolk County Legislature in August of 2009 and the first lease cycles were initiated by the Department in January of 2010. Revisions to the shellfish cultivation zone and the respective program maps may be made based upon legal requirements, local socioeconomic, and environmental factors provided to the Suffolk County through public comment mechanisms put in place by Suffolk County. If the Suffolk County Department of Economic Development and Planning (EDP), intends on making changes to the adopted maps, said changes are subject to approval and adoption by the Suffolk County Legislature.
